Important Documents for Selling Your Home

 

Listing Forms

This is the set of forms used most commonly when listing a home for sale and should be reviewed by the Seller prior to signing.

  1. Real Estate Agency Disclosure and Election - The relationship between the broker and the client are defined via this form.
  2. Exclusive Right to Sell/Rent Listing Contract Legal Language (Listing Agreement) - The employment agreement between the broker and the client.
  3. Residential Input Form - A comprehensive checklist for identification of home and its features for properly displaying the home on the Multiple Listing Service.
  4. Seller's Property Disclosure Statement - A comprehensive disclosure to assist Sellers in making the legally required disclosures and to avoid inadvertent nondisclosures of material facts.
  5. H.O.A. Condominium/Planned Community Addendum - A disclosure of and Homeowner's Association and the costs of Disclosure, Transfer, Capital Improvement and other fees.

 

Special Situation Forms

This is the set of forms that would be used if certain circumstances exist within the broker/client relationship or special circumstances regarding the location, age or services provided to the home.

  1. Consent to Limited Representation - When the broker represents both Seller and Buyer, certain limitations exist and those limitations and consent of the parties are explained.
  2. Disclosure of Information on Lead-Based Paint and Lead-Based Paint Hazards (Sales) - This form is only required if the home was constructed prior to 1978.
  3. Affidavit of Disclosure - The document that must be provided to a prospective Buyer of a property in an unincorporated area.
  4. Domestic Water Well/Water Use Addendum ("SPDS") - This document supplements the Seller's Property Disclosure Statement for properties with water wells.
